FCC Enforces Must Carry – fines Cabletron Systems for violating must-carry rules in New York – Company Business and Marketing – Brief Article

The FCC fined Cablevision Systems Corp. $127,500 last week for violating must carry rules in some of the company’s New York metro area systems.

This is first time the FCC has taken this action on a must carry complaint. An FCC spokesman said there have been must carry complaints in the past, but noted that this is the first time the commission has issued a notice of liability. Cablevision, which has 30 days to respond, claimed earlier that must carry violates its Fifth Amendment rights. The FCC refused to rule on Cablevision’s claim.

The fines stem from a 1998 complaint filed by WXTV in Patterson, N.J., which said that Cablevision refused to comply with its must carry request. The station invoked must carry rights on all of Cablevision’s 38 separate systems in the New York market, requesting Channel 41 on the dial.
