Yesterday in a newly released Supreme Court Appelate Division First Department decision in the multi-billion dollar case of The Pullman Group,(R) LLC, (Creator of all Pullman Bonds,(TM) including the Pullman Bonds (TM) for David Bowie, Motown Hit Machine Holland Dozier Holland, Ashford & Simpson, James Brown, and The Isley Brothers) beat Prudential Financial et al. again when Prudential Financial et. al were denied leave to appeal to the Court of Appeals in Albany, New York, which is the highest court in the state of New York. The stay is now lifted in the case, and the case will be tried as to defendants’ liability.

The Pullman Group,(R) LLC now won again in a 5-0 unanimous knock-out decision in multi-billion dollar case against Prudential Financial, Inc. et al. affirming on all 31 counts by a five judge panel of Justice Tom, Justice Mazarelli, Justice Rosenberger, Justice Ellerin and Justice Rubin, upholding the Honorable Justice Gammerman’s decision in which The Pullman Group,(R) LLC won. The Five Judge Panel stated in the final line of its decision: “We have considered the Defendants’ remaining contentions and find them unavailing. This constitutes the decision and the order of the Supreme Court Appellate Division First Department.” Defendants have admitted a $3 billion liability.

Discovery in this case produced 100 boxes and hundreds of pages of depositions evidencing defendants’ guilt on 31 counts including Breach of Fiduciary Duty, Breach of Contract, Misappropriation of Trade Secrets, Fraud, Tortious Interference and Aiding and Abetting Breaches of Fiduciary Duty (Against Willkie, Farr & Gallagher), as well as Civil Conspiracy.
